The following rules (“Official Rules”) are specific to the $100,000 Perfect General Election Contest (the “Contest”). In addition to these Official Rules, additional rules and Terms and Conditions (which are fully incorporated into these Official Rules by reference) (“Platform Rules”) are to be considered part of the same instrument for the purposes of this Contest.
In the event of a conflict between these Official Rules and the Platform Rules, these Official Rules will govern.
This $100,000 Perfect General Election Contest is a unique contest experience specific to the 2024 General Election on November 5, 2024, as well as any runoff, ranked choice, automatic or candidate recounts, and legal challenges for the 2024 General Election cycle.
IMPORTANT NOTICE: PLEASE READ THESE TERMS CAREFULLY, THEY FORM A BINDING CONTRACT BETWEEN YOU AND FANTASY ELECT INC. AND CONTAIN A BINDING ARBITRATION PROVISION AND A CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS AND REMEDIES AS DETAILED IN THE SECTION TITLED ARBITRATION AND CLASS ACTION WAIVER. PLEASE READ CAREFULLY. IT IS YOUR RIGHT TO CONSULT WITH AN ATTORNEY OR OTHER ADVISOR PRIOR TO ACCEPTING THE TERMS AND PARTICIPATING IN ANY OF OUR CONTESTS. WE STRONGLY ENCOURAGE YOU TO DO SO BEFORE PROCEEDING.

Eligibility
The Contest is open only to legal residents of the 50 United States and the District of Columbia (the “Eligibility Area”) who are 18 years or older (or the age of majority in the participant’s state of legal residence) as of the time of entry and are not a prohibited party identified on any government export exclusion lists (see e.g., http://www.bis.doc.gov/complianceandenforcement/liststocheck.htm). You must have a free Fantasy Elect profile in order to be eligible to participate. The Contest is void where prohibited by law. Employees, agents, successors, and assignees of Fantasy Elect, Inc. (“Fantasy Elect” “FE”), and its parent companies, affiliates, subsidiaries, advertising agencies, underwriters, and Contest companies, any other participating prize sponsor, and any entity involved with or otherwise providing services or prizes related to this Contest, (all of the foregoing, together with Sponsor, collectively referred to as "Contest Entities"), and the immediate family members (parent, child, sibling, domestic partner, or spouse of any of the foregoing) and persons living in the same household as such individuals, whether related or not, are not eligible to win. Your entry into the Contest constitutes your acceptance of these Official Rules.
An individual who has had access to any pre-release, confidential information or other information that is not available to all other entrants of a Contest and that provides the entrant an advantage in such a Contest, including any information from another daily fantasy sports contest platform, prediction market, or information from a political party, campaign, committee, political action committee, organization, governmental body, quasi-governmental organization, polling entity, prediction market, or political consultant (“Insider Data”); An employee, operator or consultant to a political campaign, party, committee, or organization where such employee, operator or consultant is prohibited from participating in Contests by the organization; A candidate for office, representative of a political campaign, board member or executive of a political organization, board member or executive of a political committee, a political oversight official, or an Immediate Family Member of a candidate for office, representative of a political campaign, board member or executive of a political organization, board member or executive of a political committee, a political oversight official; together (“Political Insiders”) are not eligible to win.
A person prohibited from participating pursuant to court order, or any state-sponsored exclusion or self-exclusion list; or A person deemed ineligible, at the sole discretion of Fantasy Elect, because of violations of the Terms or Code of Conduct; together (“Prohibited Participants”) are not eligible to win.
Non-Guaranteed Contest
The Contest is not guaranteed. Fantasy Elect may cancel the contest at any time in our sole discretion.
If, for any reason, the third party indemnifier of the contest fails to pay the prize amount Fantasy Elect may cancel the contest regardless whether the contest has already started or completed.
About the Contest
Participants are invited to create and submit one (1) free entry (“Entry”) in which they must correctly select the statistical performance of Politicians, Ballot Initiatives, Voter Propositions, and Constitutional Amendments appearing on ballots in United States jurisdictions during the 2024 General Election (“Election Outcomes”).
The $100,000 Grand Prize (the “Grand Prize”) will be awarded to the Participant who correctly predicts the Election Outcomes of all Contest Questions, subject to the terms, conditions and limitations of these Official Rules.
Participants, based on their skill, knowledge and understanding of possible Election Outcomes, must make their selections between the Contest Open Date and the Contest Start Date, determined by Fantasy Elect in its sole discretion, but under no circumstances later than the start of the first in-person voting in the United States Eastern Time Zone on Election Day, Tuesday, November 5, 2024 (the “Selection Period”).
Entry
Registration:
Participants may create and register accounts on the Fantasy Elect platform prior to the Selection Period.
To register for this Contest, visit the Website on your desktop/laptop computer, or web-enabled mobile device. Look for the links to the Contest on the Website devoted to this Contest which is referred to in these Official Rules as the “In-App Site”; the Website and In-App Site are collectively referred to in these Official Rules as the “Basic Game Microsites”). Click “Play Now.” If you are not an existing Fantasy Elect account holder, follow the instructions to register for a free Fantasy Elect account profile.
Creating An Entry:
You may submit one (1) Contest entry. You may edit your Selections at any time up until the close of the Selection Period. All selections must be finalized and submitted by the close of the Selection Period, after which no further changes will be allowed.
Participants may earn additional entries by referring new Users to Fantasy Elect. The new referred User must create and complete a Fantasy Elect account profile using the referring User’s unique referral link.
New Users are defined as those Users who do not currently have nor previously had in the past a Fantasy Elect profile account.
Selections:
In the event that one or more Election Outcomes is removed from a jurisdiction’s ballots for the 2024 U.S. Election, then Fantasy Elect will make reasonable efforts to update the Contest Microsites to reflect the change(s), and will make a reasonable attempt to notify participants of the change(s) by: sending an email to participants and/or posting a notice of the change(s) on the Contest Microsites. At that point, it is the participant’s responsibility, prior to the end of the Selection Period, to return to the Website to modify their Selection(s) with new Selections for any Election Outcomes affected by the change(s). Fantasy Elect, in its sole discretion may determine that the change(s) are substantial enough to require cancellation of the Contest.
Fantasy Elect will not automatically update any Player’s Selections in order to reflect the change(s), so unless the user takes action to correct their Selections, any previous Selections affected by a change(s) may be deemed incorrect.
In the event such changes render the Contest uninsurable then the Contest will be cancelled.
For purposes of these Official Rules, "receipt" of an entry occurs when Fantasy Elect’s servers record your registration information and designated, completed Submission as described above. As described above, you may modify your Submission(s) until the close of the Selection Period, at which point you must have submitted your selections and they become final.
Scoring
Fantasy Elect uses statistics provided by reputable and/or official sources.
We endeavor to promptly settle contests and distribute prizes, but it is also important to us to make sure we do so accurately.
The Contest will be considered final when the official state results are certified and will be sourced from ballotpedia.org or state elections officials.
Normally, any changes or corrections provided by our sources after a contest has ended and Fantasy Elect has settled the contest will not impact the already-settled contest. However, Fantasy Elect reserves the right in its sole discretion to revise scores after they are released in the unlikely event of potential scoring error by our sources or Fantasy Elect. In those circumstances, the contest results may be altered, and payments may be reversed and redone, based on the correction.
Ties
A “Tie” occurs when the validly submitted Submission of two or more verified eligible Participants qualifies as winning submissions with perfect selections.
In the event of a tie, Fantasy Elect will use the Tie Breaker question to determine the winner.
For clarity, only one Participant can be the Grand Prize winner.
The Tie Breaker question requires all participants to enter the total voter turnout for the 2024 Presidential General Election prior to the end of the Selection Period, with the winner being determined by the Participant that comes closest without going over the actual voter turnout.
Question Pool
The Question Pool includes questions regarding statistical performance based on Politicians, Ballot Initiatives, Propositions, and Constitutional Amendments appearing on the ballot in the 2024 General Election and any resulting runoffs, ranked choice voting, recounts, or legal challenges in any jurisdiction regardless whether a Politician has Suspended or Formally Ended their campaign.
Question Types
The Contest may consist of the following question types:
Prize
The verified participant whose valid Submission with perfect selections for all questions in the Contest will win one hundred thousand dollars ($100,000), payable in twenty (20) annual installments (the “Grand Prize”). The initial installment will be paid no later than the last business day of 2025 and each annual payment thereafter will be paid no later than the last business day of each year.
THERE IS A LIMIT OF ONE (1) PRIZE PER WINNER IN THIS CONTEST. Fantasy Elect may, in its sole discretion, include additional prizing after these Official Rules have been posted; in which case we reserve the right to update these Official Rules to include descriptions of additional prizes.
To be eligible to receive the prize, the potential Grand Prize winner must verify their identity, location, and eligibility as directed by Fantasy Elect, which may require verification through our third party agents or service providers.
The potential Prize winner will be required to provide Contest Entities with proof that they are the authorized account holder for each of the credentials associated with the winning Fantasy Elect account. Any unresolved discrepancies during verification of eligibility that are not resolved to the satisfaction of Fantasy Elect, as determined in its sole and absolute discretion, will result in disqualification of the Submission and any potential prize will be forfeited.
The Grand Prize is personal to the winner only and may not be transferred or assigned including upon death. Only the Grand Prize will be awarded and no substitutions or redemptions will be made, except that Fantasy Elect reserves the right to substitute any prize package with another prize of equal or greater value in the event that the advertised prize (or any component thereof) is not available. Reporting and payment of all applicable taxes, fees, and/or surcharges, if any, arising out of, or resulting from, acceptance or use of a prize, are the sole responsibility of the winner. Fantasy Elect expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prize. Restrictions, conditions, and limitations apply. Winner may be required to agree to additional terms & conditions imposed by the third party Prize provider or vendors. Contest Entities will not replace any lost or stolen prize items.
Conduct
By entering the Contest, participants agree to comply with and be bound by these Official Rules. The Official Rules will be posted at the Contest Microsites throughout the Contest. Failure to comply with these Official Rules may result in disqualification from the Contest. Participants further agree to comply with and be bound by the decisions of the Contest Entities, which will be final and binding in all respects. Fantasy Elect reserves the right in its sole discretion to disqualify any individual found to be: (a) tampering or attempting to tamper with the entry process or the operation of the Contest, the Basic Game, or any Fantasy Elect website; (b) violating the Official Rules; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Fantasy Elect property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR APPLICATION, OR UNDERMINE THE LEGITIMATE OPERATION OF ANY FANTASY ELECT CONTEST OR THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, FANTASY ELECT RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
Multiple accounts & collusion
Each user on Fantasy Elect is permitted to maintain one account. "Multi-accounting" or colluding with any other entrant is expressly prohibited. If a user has opened, maintained, used, colluded with, or controlled more than one account, as determined in Fantasy Elect's sole discretion, we may terminate or suspend any or all accounts and may revoke or withhold any prizes that the user(s) has or have won.
Any attempted "Multi-accounting" or colluding with any other entrant is expressly prohibited as provided herein.
Fantasy Elect may close entry to the Contest at any time in its sole discretion, but at a minimum prior to the opening of the first 2024 General Election polls in the Eastern U.S. time zone on election day, November 5, 2024.
Suspended accounts
If you undertake any actions that are detrimental to Fantasy Elect or other users on Fantasy Elect's service, we may suspend some or all functions associated with your account. We expect suspended users to respect the disciplinary actions that we have imposed on your accounts. Contest integrity
Contest integrity and transparency are pillars of our service and are something we strive to offer in all our contests and games. In efforts to uphold these values, we perform regular integrity checks on all the entries and drafts. If an entry is flagged by our security system it will be manually reviewed for further inspection. Following the manual review, the draft will either be deemed eligible to continue or will be flagged as ineligible and will be cancelled and removed from the Contest.
Fantasy Elect reserves the right to cancel contests at our sole discretion, without any restrictions. Typically, we would only do so in cases where we believe that due to problems on our services or occurring in events impacting the elections, there would be questions regarding the integrity of the contest.
If a paid entry contest is cancelled all Participants will have their entry fees refunded.
Indemnification
You agree to indemnify, defend and hold harmless Fantasy Elect, its parents, subsidiaries, affiliates, and agents, as well as the officers, directors, employees, shareholders, and representatives of the foregoing entities, from and against any and all losses, damages, liability, claims, settlements, injury to all persons and property, and costs and expenses (including without limitation, reasonable attorneys’ fees and expenses) as incurred, resulting from, arising out of, or related to, your participation in a contest, your use of the Services, Site, App, or content, our use of information that you submit to us, any misrepresentations made by you, your breach or violation of the Terms, your infringement of any intellectual property or other right of any other person or entity, the receipt, ownership, use or misuse of any prize, and any claims, judgments, prosecutions, regulatory or administrative actions taken by a local, state, or federal government as a result of your use of Fantasy Elect and its platforms to violate a local, state, or federal law or regulation.
Fantasy Elect or an affiliate will provide you with prompt written notice of a claim it believes is subject to indemnification under this provision and permit you to control the defense, settlement, adjustment, or compromise of the claim, but Fantasy Elect may, at its sole discretion, elect to solely control the defense, settlement, adjustment, or compromise of any claim, in which event: (A) you agree to cooperate with Fantasy Elect’s sole control and provide any assistance that may be reasonably necessary, and (B) you shall not be relieved of your indemnification and hold harmless obligations under this Section.
Fantasy Elect may employ counsel at its own expense to assist it with respect to the claim, but if such counsel is necessary because of a conflict of interest of either you or your counsel, or because you do not assume control of the claim, you will bear the expense of such Fantasy Elect-employed counsel. Fantasy Elect shall have no authority to settle a claim on your behalf.
This indemnification provision applies to direct party claims (any claims You bring against Fantasy Elect) in addition to third-party claims.
Disclaimer
Fantasy Elect makes no express or implied guaranties or warranties and expressly disclaims all warranties, of merchantability, of any Contest, Services, Site, App, or Content; nor does Fantasy Elect guarantee the accuracy and/or the completeness of any data and Fantasy Elect shall have no liability for any errors, omissions, or damages arising out of Participant’s participation in any Contest or use of the Fantasy Elect’s services. You acknowledge that there may be interruptions in service or events that are beyond our control. While we use reasonable efforts to keep the Services accessible, the Services may be unavailable from time to time for any reason including, without limitation, system down time for routine maintenance. You further understand that there may be interruptions in service or events on third-party sites that may affect your use of the Services and that are beyond our control to prevent or correct. Interruptions in the Services shall not serve as a basis for any claim against Fantasy Elect. Fantasy Elect makes no representation or warranty, express or implied, as to any results to be obtained by Participant or any other person or entity from use of Fantasy Elect’s services or the Contest.
Fantasy Elect may limit access, via technological means, to the Services in the Excluded Jurisdictions. If you attempt to Deposit or play in any Contest while located in an Excluded Jurisdiction, you may be in violation of the law of such Excluded Jurisdiction and these Terms, and subject to having your Account suspended or terminated, and all Prizes won may be refunded, voided and returned to Fantasy Elect. You hereby agree that we cannot be held liable if laws applicable to you restrict or prohibit your participation. We make no representations or warranties, implicit or explicit, as to your legal right to participate in any service offered nor shall any person affiliated, or claiming affiliation, with us have authority to make any such representations or warranties. We do not intend that the Contests, Site or App, and the Services to be used by persons are present in jurisdictions in which the playing of fantasy sports contests may be prohibited or restricted.
Marketing Cooperation
By participating in any Contest or Fantasy Elect promotion, you agree to cooperate in all advertising, marketing and publicity material and activities we may, at our expense, produce or arrange. You also agree, if requested: (a) to wear any branded clothing or attire we may provide; and (b) to sign, if requested, an irrevocable release form allowing us, without any compensation being payable, to use your name, photograph, likeness, details of the country and/or city where you live, any comments made by or attributed to you, and to incorporate any such information and any audio/visual recording or broadcast for such promotional purposes, in any media, throughout the world.
Where you participate in any event which we host or arrange in connection with a Contest or promotion, you agree not to make use of any third-party branding or advertising for any organization which we consider to be our competitor, including without limitation any branding or advertising for any other gaming company, and you agree not to conduct yourself in a manner that might, in our reasonable opinion, bring us, any of our affiliates or any of our or their respective brands into disrepute. In the event of any breach of this requirement, we reserve the right not to award a Prize or to request the return of any Prize awarded.
With respect to any lineup submission you make in the course of participating in any Contest or Fantasy Elect promotion, you declare that the relevant material will be all your own original work and will not infringe on the intellectual property rights or other rights of any person. You agree to assign all rights (including intellectual property rights) for such material, and if moral rights exist, you agree to waive such rights. Moral rights are the rights to claim authorship of the work and to object to any distortion, modification of, or other derogatory action in relation to said work, that would be prejudicial to the author’s honor or reputation. You agree to execute all documents and to do any other things reasonably necessary to assure our title to such material, and to allow us to fully use and exploit such material.
Disputes:
BINDING ARBITRATION AGREEMENT. AGREEMENT TO ARBITRATE. YOU AND FANTASY ELECT BOTH AGREE TO RESOLVE ANY AND ALL DISPUTES, CONTROVERSIES OR CLAIMS THAT IN ANY WAY ARISE OUT OF OR RELATE TO THESE TERMS OR FROM ANY SERVICES YOU RECEIVE FROM US (OR FROM ANY ADVERTISING FOR ANY SUCH SERVICES), INCLUDING ANY DISPUTES BETWEEN YOU AND OUR EMPLOYEES OR AGENTS (“DISPUTE(S)”), ONLY BY ARBITRATION ON AN INDIVIDUAL BASIS OR IN SMALL CLAIMS COURT. YOU UNDERSTAND THAT BY AGREEING TO THESE TERMS, ARBITRATION OR A SMALL CLAIMS ACTION WILL BE THE SOLE AND EXCLUSIVE MEANS OF RESOLVING ANY DISPUTE BETWEEN US. YOU ALSO UNDERSTAND THAT BY AGREEING TO THESE TERMS, YOU AND SPONSOR ARE GIVING UP THE RIGHT TO BRING A CLAIM IN COURT OR IN FRONT OF A JURY (EXCEPT FOR MATTERS THAT MAY BE BROUGHT IN SMALL CLAIMS COURT), AND THAT YOU AND SPONSOR ARE GIVING UP THE RIGHT TO PROCEED WITH ANY CLASS ACTION OR OTHER REPRESENTATIVE ACTION.
We also both agree that:
Notice of Dispute. If either you or Sponsor intends to arbitrate under these Terms, the party seeking arbitration must first notify the other party of the Dispute in writing at least 30 days in advance of initiating the arbitration. Notice to Fantasy Elect should be sent to Fantasy Elect either by mail to Fantasy Elect, Attn: CSC Global 251 Little Falls Drive, Wilmington, New Castle County, Delaware 19808; or info@fantasyelect.io. Notice to you will be to your email address(es) and street address(es), if any, that Fantasy Elect has in its records at the time the notice is sent. The notice must describe the nature of the claim and the relief being sought. If we are unable to resolve the Dispute within 30 days, either party may then file a claim for arbitration.
Arbitration Procedure. The Federal Arbitration Act applies to these Terms. Except for small claims court cases, any and all Disputes will be resolved by arbitration administered by the American Arbitration Association ("AAA"), which will apply the AAA's Consumer Arbitration Rules (excluding any rules or procedures governing or permitting class actions). You can get additional information from the AAA (www.adr.org). These Terms govern to the extent they conflict with the AAA’s Rules.
Small Claims Court Option. As an alternative to arbitration, you may bring an individual action in small claims court in your county of residence or Travis Country, Texas provided that your Dispute meets the requirements of the small claims court.
Arbitration Location. Unless you and Fantasy Elect agree otherwise, the arbitration must take place, or the small claims action must be filed, in the county of your primary residence or Travis County, Texas.
Arbitration Fees and Expenses. We will reimburse any filing fee that the AAA charges you for arbitration of the Dispute. If you provide us with signed written notice that you cannot pay the filing fee, we will pay the fee directly to the AAA. If the arbitration proceeds, we will also pay any administrative and arbitrator fees charged later.
Severability. If any part of this agreement to arbitrate is found by a court of competent jurisdiction to be unenforceable, the court will reform the agreement to the extent necessary to cure the unenforceable part(s), and the parties will arbitrate their Dispute(s) without reference to or reliance upon the unenforceable part(s). However, if for any reason the Class Action Waiver set forth below cannot be enforced as to some or all of the Dispute, then the agreement to arbitrate will not apply to that Dispute or portion thereof, but the remainder of the agreement to arbitrate will be binding and enforceable. The parties do not agree to class arbitration or to the arbitration of any claims brought on behalf of others.
CLASS ACTION WAIVER. THESE TERMS DO NOT ALLOW CLASS OR COLLECTIVE ARBITRATIONS, EVEN IF THE AAA PROCEDURES OR RULES WOULD. NOTWITHSTANDING ANY OTHER PROVISION OF THESE TERMS, THE ARBITRATOR MAY AWARD MONEY OR INJUNCTIVE RELIEF ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE THE RELIEF WARRANTED BY THAT PARTY'S INDIVIDUAL CLAIM. ARBITRATION OR COURT PROCEEDINGS HELD UNDER THESE TERMS CANNOT BE BROUGHT, MAINTAINED OR RESOLVED ON BEHALF OF OR BY A CLASS, AS A PRIVATE ATTORNEY-GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY. IN ADDITION, INDIVIDUAL PROCEEDINGS CANNOT BE COMBINED WITHOUT THE CONSENT OF ALL OF THE PARTIES. ANY QUESTION REGARDING THE ENFORCEABILITY OR INTERPRETATION OF THIS PARAGRAPH WILL BE DECIDED BY A COURT AND NOT THE ARBITRATOR.
JURY TRIAL WAIVER. IF FOR ANY REASON A DISPUTE PROCEEDS IN COURT RATHER THAN THROUGH ARBITRATION, YOU AND FANTASY ELECT AGREE THAT THERE WILL NOT BE A JURY TRIAL. YOU AND FANTASY ELECT UNCONDITIONALLY WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY ACTION, PROCEEDING OR COUNTERCLAIM IN ANY WAY ARISING OUT OF OR RELATING TO THESE TERMS. IN THE EVENT OF LITIGATION, THIS PARAGRAPH MAY BE FILED TO SHOW A WRITTEN CONSENT TO A TRIAL BY THE COURT.
Choice of Law. These Terms and the relationship between the parties, including any claim or dispute that might arise between the parties, whether sounding in contract, tort, or otherwise, will be governed by the laws of the State of Texas without regard to its conflict of law provisions. In no event will the parties bring claims against one another under the laws of another jurisdiction.
Forum.
If for any reason a Dispute proceeds in court rather than through arbitration, all such Disputes (regardless of theory) arising out of or relating to these Terms, or the relationship between you and Fantasy Elect, will be brought exclusively in the courts located in the county of Travis, Texas or the U.S. District Court for the Western District of Texas. In such cases, you and Fantasy Elect agree to submit to the personal jurisdiction of the courts located within the county of Travis, Texas or the Western District of Texas, and agree to waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts.
